End User License Agreement
This End User License Agreement ("EULA") is between you and OnTheFarm, not Apple. It governs your licensed use of the OnTheFarm iOS application. Our Terms of Service and Privacy Policy also apply.
1. License
OnTheFarm grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded products you own or control, as permitted by the App Store Usage Rules, including use through Family Sharing or volume purchasing where those rules allow it. The app is licensed, not sold.
2. Restrictions
You may not copy, rent, lease, sell, sublicense, redistribute, reverse engineer, circumvent security, use the app to violate law or third-party rights, or exploit the app except where applicable law expressly permits it. You may not use the app if you are under 13.
3. Maintenance and support
OnTheFarm, not Apple, is solely responsible for maintenance and support for the app. Apple has no obligation to provide maintenance or support. Contact [email protected].
4. Warranty
To the extent permitted by law, the app is provided "as is" and "as available." OnTheFarm disclaims implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
5. Product claims
OnTheFarm, not Apple, is responsible for addressing claims relating to the app or your possession and use of it, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection, privacy, or similar laws.
6. Intellectual property claims
If a third party claims that the app or your use of it infringes intellectual property rights, OnTheFarm, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim. Copyright reports about user content are handled under our Copyright and DMCA Policy.
7. Legal compliance
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorism-supporting country, and that you are not listed on a U.S. Government prohibited or restricted-party list.
8. Third-party terms
You must comply with applicable third-party terms when using the app, including your wireless-data agreement, Apple services, payment providers, maps, transit, calendar, and external ticket-provider terms.
Maps, directions, transit arrivals, public event listings, advertisements, organizer content, venues, and external ticket services are third-party or external services. To the fullest extent permitted by law, you use them at your own discretion and should independently verify time-sensitive or safety-critical details.
9. Termination
This license continues until terminated. It ends automatically if you fail to comply with this EULA. When it ends, you must stop using and delete the app. Sections that by their nature should survive termination will survive.
10. Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this EULA. When you accept it, Apple has the right to enforce it against you as a third-party beneficiary.
