Copyright and DMCA Policy

OnTheFarm respects intellectual property rights. We respond to sufficiently complete copyright notices and counter-notifications under the Digital Millennium Copyright Act (17 U.S.C. § 512), remove or restrict access to material when appropriate, and may terminate repeat infringers.

Submit a copyright notice

Send a written notice to the registered designated agent at [email protected] or the designated-agent mailing address below. A valid notice must include:

1. Your physical or electronic signature, if you are the copyright owner or authorized to act for the owner.
2. Identification of the copyrighted work claimed to have been infringed, or a representative list if the notice covers multiple works.
3. Identification of the material claimed to infringe, with enough information for us to locate it, such as the OnTheFarm event, post, message, profile, URL, or account.
4. Your name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the notice is accurate and that you are the copyright owner or authorized to act for the owner.

Knowingly misrepresenting that material is infringing may expose you to liability. Consider whether fair use or another exception applies before sending a notice.

What happens after a notice

We may remove or disable access to the identified material and notify the affected user. We may send the notice, including the claimant's contact information, to that user as part of the process.

Submit a counter-notification

If you believe material was removed or disabled because of mistake or misidentification, send a written counter-notification to the same contact. It must include:

1. Your physical or electronic signature.
2. Identification of the removed material and where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
4. Your name, address, and telephone number, plus consent to the jurisdiction of the appropriate U.S. Federal District Court and acceptance of service of process from the person who submitted the original notice or that person's agent.

If we receive a valid counter-notification, we may restore the material after 10 to 14 business days unless the original claimant tells us they filed a court action seeking to restrain the challenged activity.

Repeat infringers

In appropriate circumstances, OnTheFarm may suspend or terminate accounts of users who repeatedly infringe copyright. We may also act against accounts that misuse the notice process.
